Right now, there is a bill proposal to regulate CBD as a dietary supplement circulating in the House of Representatives. It’s likely going to pass because there is bipartisan support for CBD regulation.

Next, the bill will enter the Senate, where it’s once again likely to pass due to bipartisan support. Then, hopefully, this bill will come across President Biden’s desk and be signed into law.

Since CBD will be regulated as a dietary supplement, all brands will have to follow the FDA Dietary Supplement Guidelines.

The FDA might start regulating what is allowed on labels. For instance, New York is enforcing that all full spectrum products denote there is THC in the product. These protocols might become common under FDA regulation.

Top CBD companies are already labeling CBD as dietary supplements. They already follow the regulation in place, just as if CBD were vitamin C or omega-3 fatty acids.

To sell CBD, you will need a merchant processing software system set up for CBD sales. They must be backed by a bank that is familiar with cannabis sales laws. You will also need a bank for your own business that specializes in cannabis banking.

Many companies get around this by not disclosing they are selling CBD. These practices can cause fines or deactivated accounts.

You also can’t advertise on Google or Facebook. Trying to do so can cause your account to be shut down. Regulation can open opportunities on Google, Facebook, and Amazon.
